The petitioners are apprehending their arrest in a case instituted under Sections 341, 342, 323, 385 and 307 of the Indian Penal Code.
It has been alleged by the informant that the coaccused Rahul Kumar called the informant at his house by calling him from mobile and tied the hands and legs of the informant and assaulted him by rod causing head injury. It has further been alleged that Rs.1,00000/- was demanded from the informant as Rangdari.
It has been submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.39415 of 2015 (2) dt.28-09-2015 the petitioners have got no criminal antecedent. It is a case and counter case between the parties. Petitioner no.3 is a lady. From perusal of the impugned order, it appears that the injuries sustained by the informant are simple in nature. On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Madhepura P.S.Case No.250 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
