JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2016 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506 of the Indian Penal Code. The prosecution case is that on 23.03.2016 at 4:15 P.M the petitioner was assaulting the father of the informant namely Md. Nabi Hasan. When the informant went to rescue then petitioner caused injury to the informant. Thereafter mother of the informant went to rescue then she was also caused injury by the petitioner.

It is submitted by learned counsel for the petitioner that informant is the son-in-law of the brother of the petitioner and is a veteran criminal. In fact, no injury has been caused to the informant or the mother of the informant. The two injuries of the father of the informant have been found to be simple in nature.

Patna High Court Cr.Misc. No.36114 of 2016 (3) dt.09-09-2016 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for bail, if the petitioner surrenders within a period of six weeks in connection with Phulwarisharif P.S. Case No. 188 of 2016, pending in the Court of learned Judicial Magistrate, 1st Class, Patna.

With the observations above, the application stands disposed off.
