Patna High Court C.Misc. No.927 of 2016 (2) dt.20-09-2016
IN THE HIGH COURT OF JUDICATURE AT PATNA
CIVIL MISCELLANEOUS JURISDICTION No.927 of 2016 ====================================================== Sri Kant Kumar .... .... Appellant/s
Versus
Madhya Bihar Gramin Bank through its Director Madhya Bihar Gramin Bank & Ors .... .... Respondent/s ====================================================== Appearance :
For the Appellant/s : Mr. Ajay Kumar Sharma For the Respondent/s : Mr. Ved Prakash Srivastva ====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 20-09-2016 Heard the learned counsel for the petitioner and the learned counsel for the Bank.
Perused the impugned order dated 24.06.2016 passed by learned Munsif III, Gaya in Title Suit No.44 of 2014. From perusal of the impugned order, it appears that the learned Court below has passed the reasoned order as the application has been filed by the petitioner for directing the Bank to sell the tractor and realize the dues of the loan. The plaintiff has filed the suit for declaration that he is a marginal farmer and he is not liable to pay the loan.
In such view of the matter, it is not a case for interference in supervisory jurisdiction and thus, this civil miscellaneous application is dismissed.
