JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-07-2015 The petitioner prayed for directing the Bihar State Housing Board (herein after referred to as "the Board") to demarcate Digha Plot no. 8M/214 and to develop the same by constructing road, laying down the water line and drainage. IA No.5772/2015 has been filed by him for allotting a piece of land either in Kankarbagh, Bahadurpur, Hanuman nagar or anywhere in Patna in place of Digha area. The petitioner further submits that similarly situated Dr.Girja Nand Prasad has been allotted alternate plot in view of direction of this court in C.W.J.C.No. 5423 of 2004.

Counter affidavit has been filed by the Board stating that the allotted plots at Digha by the Board are at present

Patna High Court CWJC No.15381 of 2012 (3) dt.22-07-2015 2/2 under consideration by the State Government in light of Digha Act, 2010.

The writ petition is disposed of with liberty to the petitioner to approach the Board with representation, which would be disposed of within a period of three months. (Samarendra Pratap Singh, J) Shashi.
