JUSTICE PRABHAT KUMAR JHA ORAL ORDER 10-11-2015 Heard the learned counsel for the petitioners, the learned counsel for the complainant and the learned Additional Public Prosecutor.

The petitioners apprehend their arrest in a case under Section 498A, 406 of the Indian Penal Code and under section 3⁄4 of Dowry Prohibition Act.

The petitioners are father, mother, maternal uncle and married sisters of the husband of the complainant. It is submitted that petitioners have no manner of

Patna High Court Cr.Misc. No.42639 of 2015 (3) dt.10-11-2015 2/2 concern with the family affairs of the husband and wife. They made efforts for reconciliation but the dispute could not be resolved.

The learned counsel for the complainant submits that the complainant is willing to restore the matrimonial relation but her husband is not wanted to keep her.

Considering the facts aforesaid and the fact that petitioners are in-laws of the complainant and no specific allegation is made against them, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Abhishek Kumar, learned Judicial Magistrate, 1st class, Gopalganj in Complaint Case No. 361 of 2015 (Trial No. 4817/15), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
