JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The application is for grant of bail for the offence under Sections 307 and other Section of the Indian Penal Code. The allegation against the petitioner is that he fired upon the injured causing injury to the injured, Karu Kumar. It has been submitted on behalf of the petitioner that though in the FIR, it has been alleged that in Para 43 of the case diary, it has been mentioned that one Gore Singh chased Karu Singh and fired upon him resulting injury to him. The petitioner is in custody since 30.06.2016. It has also been submitted that the petitioner has been falsely implicated due to land dispute between the parties.

Patna High Court Cr.Misc. No.39645 of 2016 (3) dt.21-12-2016 2/2 Heard learned A.P.P. also, who has admitted that though in Para 43 of the FIR, it has been mentioned that one Gore Singh chased Karu Singh and fired upon him resulting injury to him. Having heard both sides and in view of the facts as stated above, let petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM, Lakhisarai in connection with Surajgarha P.S.Case No.10 of 2013.
