Heard learned counsel for the petitioner, learned A.P.P. for the State and counsel for the informant. The petitioner seeks regular bail in connection with Turkauliya P.S. Case No. 669 of 2021 lodged under Sections 341, 323, 302, 326 & 34 of the I.P.C.
As per the prosecution case, there is specific allegation against the petitioner that he has assaulted by dagger in the stomach of the deceased in result the intestine came out and he died.
Learned counsel for the petitioner submits that the other co-accused persons have been granted bail in this case and
Patna High Court CR. MISC. No.65339 of 2022(2) dt.16-02-2023 2/2 case diary is required in this case. Therefore, case diary may be called for. Counsel further submits that antecedent of the petitioner is clean and he is in custody since 26.08.2022. Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner only due to which the death has been caused. Learned counsel for the informant vehemently opposes the prayer for bail and submits that there are in total 3-4 known and unknown persons involved in the crime. The specific allegation has been made against the petitioner to assault due to which the deceased died.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
With this observation, the bail application stands rejected.
