The present application has been filed for modification of the order dated 03.02.2015 passed in Criminal Miscellaneous No.4402 of 2015 to the extent of extending the period of surrender.
The petitioner was granted anticipatory bail in connection with a case registered for the offence punishable under Section 47(a) of the Excise Act.
It is submitted by learned counsel for the petitioner since the petitioner is suffering from renal disease, he could not surrender before the learned Court below within the stipulated
Patna High Court CR. MISC. No.63936 of 2019(2) dt.16-10-2019 2/2 period and hence on the ground of medical issue, he prays for grant of three weeks further time to surrender before the learned Court below.
In the circumstances, let the date of surrender be extended by three weeks calculated from the date of receipt or production of the order.
The order dated 03.02.2015 passed in Criminal Miscellaneous No. 4402 of 2015 in connection with Excise Case No. 14 of 2014, pending before the learned CJM, Samastipur stands modified to the extent as indicated above. Accordingly, the modification application is disposed of.
