2. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. Total 279 litres of Nepali liquor was recovered from the shop of this petitioner.

4. Learned counsel for the petitioner submits that petitioner never dealt with wine and he has no concern with the alleged recovered liquor. Nothing incriminating article or illicit

Patna High Court CR. MISC. No.64544 of 2025(2) dt.04-12-2025 2/2 liquor has been recovered from the conscious possession or premises of the petitioner. Petitioner claims clean antecedent and is in custody since 19.07.2025.

5. Learned A.P.P. for the State vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of Excise, Jhanjharpur in connection with G.R. No. 597/2024, arising out of Ghoghardiha P.S. Case No. 116 of 2024 dated 23.08.2024. (Prabhat Kumar Singh, J) P.K.P./- U
