JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 379, 307 of the Indian Penal Code. The prosecution case is of making assault to the informant and brother of the informant causing serious injuries. The petitioners were named in the F.I.R but on conclusion of the investigation the petitioners were not sent up for trial and subsequently final form was accepted. During trial of the co-accused the petitioners have been summoned in exercise of jurisdiction under Section 319 Cr.P.C. It is submitted by learned counsel for the petitioners that learned Sessions Judge has not deliberated the evidence which persuaded learned Trial Court to summon the petitioners as accused. The petitioners undertake to appear before learned Trial Court regularly.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Wazirganj(Tankuppa) P.S. Case No. 66 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Learned Trial Court will be at liberty to cancel the bail bonds of the petitioners, if the petitioners default for two consecutive occasions during trial.
