JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioner seeks bail in connection with Forbesganj (Simraha) P.S. Case No. 276 of 2019, registered for the offences punishable under Sections 364, 365 IPC and later on Section 302/34 IPC was added.

Younger brother of the informant had gone in the field and thereafter he was traceless and later on his dead body was found and he was last seen with two accused persons and allegation as per FIR is that there was dispute with respect to measurement of land.

Submission of learned counsel for the petitioner is that two stories are coming with respect to same occurrence and there is nothing against the petitioner and he is in custody for more than seven months and charge sheet has been submitted and he is ready to co-operate in disposal of trial.

Patna High Court CR. MISC. No.60554 of 2019(4) dt.31-01-2020 2/2 Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail of the petitioner. In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj (Simraha) P.S. Case No. 276 of 2019 subject to the condition that he has to co-operate in disposal of the trial and appear before court as and when required.
