2. Petitioner seeks regular bail in connection with Raghunathpur P. S. Case No. 147 of 2024 in a case registered for the offences punishable under Sections 103(1), 238, 3(5) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, marriage of the daughter of informant was solemnized with co-accused Dukhan Manjhi and on 11.11.2024 informant received information that she has been killed. Informant suspects that all the F.I.R. named accused persons, including this petitioner, committed murder of her daughter and threw her dead body in sugarcane field.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner
Patna High Court CR. MISC. No.65841 of 2025(3) dt.11-11-2025 2/2 is not a family member of the deceased rather she is merely a co-villager of the husband of deceased. Informant is not an eye witness of the alleged occurrence and she has not disclosed the source of information as to how she came to know that this petitioner is involved in the alleged offence. He further submits that cousin father-in-law of the deceased has already been granted regular bail by co-ordinate Bench of this Court vide order dated 15.10.2025 passed in Cr. Misc. No. 50996 of 2025. Petitioner claims clean antecedent and is in custody since 26.05.2025. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, East Champaran, Motihari in connection with Raghunathpur P. S. Case No. 147 of 2024.
