1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Kursakanta P.S. Case no. 177 of 2023 registered under sections 20 and 22 of the NDPS Act.
3. As per the prosecution case, 1.978 kg of ganja was recovered from the motorcycle of the petitioner and the petitioner was taken into custody.
4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession or from his motorcycle. He is in custody since 23.7.2023 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner being in custody since 23.7.2023, chargesheet having been submitted in the case and the petitioner not having any criminal case under the NDPS case, the Court directs the petitioner to be enlarged on bail in connection with Kursakanta P.S. Case no. 177 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge -cum- the Special Judge, NDPS Act, Araria.
