JUSTICE SUDHIR SINGH ORAL ORDER 09-11-2015 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are languishing in custody since 14.07.2015 in connection with Karpi P.S. Case No. 110 of 2015 for the offences instituted under Section 365 of the IPC. The prosecution story, in brief, is that the informant's brother Neeraj Kumar was called for, through his mobile, by his relative i.e., brother-in-law Shiv Nandan Das @ Hero and Dinesh Ram to come at the Petrol Pump and after that Neeraj Kumar gone to that place and not returned home. After few days, his dead body was recovered. It is alleged that Shiv Nandan Das alongwith Jagdish Ram and Dinesh Ram have kidnapped him due to love

Patna High Court Cr.Misc. No.42875 of 2015 (3) dt.09-11-2015 2/2 affair between Anita Kumari, the elder daughter of Jagdish Ram. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners are in custody since 14.07.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioners. The petitioners have been named in the FIR merely on the basis of suspicion. There is no direct or indirect evidence to suggest their implication in the present case. There is no circumstantial evidence to show the implication of the petitioners in the present case.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Arwal, Jehanabad, in connection with Karpi P.S. Case No. 110/2015.
