JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 The present application has been filed for restoration of Cr. Misc. No. 25259 of 2014 which stood dismissed for non-prosecution on 30.07.2015 by a Co-ordinate Bench of this Court now retired.
It appears from the record that the bail application was filed on 18.06.2014, thereafter case diary was called for by a Co-ordinate Bench of this Court vide order dated 3.11.2014 but it stood dismissed for default vide order dated 09.12.2014 due to non prosecution. Thereafter vide order dated 20.05.2015 passed in Cr. Misc. No. 6250 of 2015 by the same Coordinate Bench Cr. Misc. No. 25259 of 2014 was restored.
Since, the case diary was returned, then again case diary was called for vide order dated 06.07.2015, but again the counsel for the petitioner allowed the said Cr. Misc.
application to be dismissed for non-prosecution vide order dated 30.07.2015 by another Bench of this
Patna High Court Cr.Misc. No.7229 of 2016 (2) dt.18-02-2016 Court. The facts reflect a design of Bench hunting. Hence, this Court is not inclined to restore Cr. Misc. No. 25259 of 2014. Accordingly, the restoration application stands dismissed.
