It appears from the said counter affidavit that in the light of this Court's order, upon consideration by the Educational Fee Fixation Committee, a decision has been taken, fixing fees to be charged by the three Private Medical Colleges, namely, Katihar Medical College, Katihar, Narayan Medical College, Jamuar, Rohtas at Sasaram and Mata Gujri Medical College, Kishanganj. Patna High Court CWJC No.15966 of 2016(11) dt.10-09-2018 2/2 Government of Bihar, has come out with a notification containing maximum tuition fee and developmental fee which can be charged by these three medical colleges for MBBS Under Graduation course for the academic sessions 2018-19, 2019-20 and 2020-21.

Mr. Dinu Kumar, learned counsel appearing on behalf of the petitioner has drawn my attention to Clause (2) of the notification dated 20.07.2018, to submit that the fee which has been prescribed in the notification to be charged excludes Hostel Fee, Transport Fee and Mess charge etc, which ought to have been included by the Educational Fee Fixation Committee for the purpose of computation of total amount to be charged. I do not find any irregularity on the part of the Educational Fee Fixation Committee in keeping the charges, namely, Hostel Fee, Transportation Fee and Mess charge excluded from tuition fee and developmental fee, in view of the nature of the charges which are levied against those heads.

This application stands disposed of.
