JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 20-01-2017 As prayed, petitioner is permitted to implead the Divisional Commissioner, Saharsa and one Manan Yadav, son of late Hari Kishun Yadav as respondent nos. 5 and 6 respectively in course of the day.

In view of the stand taken by the State respondents in the counter affidavit that the private respondent has preferred Appeal No.217 of 2014 against the order passed by the D.C.L.R., Madhepura, this writ application is being disposed of with a direction to the Divisional Commissioner, Saharsa to dispose of the appeal on its own merit and in accordance with law within a period of three months

Patna High Court CWJC No.14351 of 2015 dt.20-01-2017 2/2 from the date of receipt/production of a copy of this order, if the same has already not been disposed of, as the appeal filed in the year 2014 has remained pending till date.

However, it is made clear that if the petitioner has not appeared, he has to appear along with a copy of this order.
