JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 05-11-2018 After hearing the parties and noticing the controversy involved, the Court is of the considered view that factual enquiry can better be done by the Appellate Authority. In view of the availability of forum of State Appellate Authority, it would be appropriate that the petitioners may approach the State Appellate Authority so that the dispute involved in the writ petitions is appropriately decided by it. Both the writ petitions are disposed of with liberty to the petitioners to file appeal before the State Appellate Authority. If the said appeal is filed, the State Appellate Authority shall condone the delay and decide the appeal on merit considering the fact that the present writ petitions have remained pending before this Court for the last five years.
With the aforesaid, the both the writ petitions stand disposed of.
