KUMAR ORAL ORDER 29-11-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. Petitioner, apprehends his arrest in connection with Patrakar Nagar P.S. Case No. 268 of 2019 registered for the offences punishable under Sections 420, 376, 313, 120(B) of the Indian Penal Code.

As per First Information Report there is specific allegation against the petitioner that he has established physical relation with victim (informant) several times on the false promise of marriage and so victim became pregnant but petitioner did not marry her.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.60078 of 2019(4) dt.29-11-2019 2/2 that he is innocent and has been falsely implicated in this case. Petitioner has no criminal antecedent.

Learned counsel for the informant opposed the prayer for pre-arrest bail.

Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on prearrest bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-X-cum-A.C.J.M., Patna, in connection with Patrakar Nagar P.S. Case No. 268 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure subject to verification that petitioner has no criminal antecedent.
