The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(A), 41 of the Bihar prohibition and Excise Act.
It is a case of recovery of 95 litres of country made liquor from 2 motorcycles and from open place. On the basis of chowkidar, the name of petitioner sprang up in this case.
It is submitted by learned counsel for the petitioner that petitioner is innocent and has committee no offence. It is also submitted that petitioner has no concern with the seized illicit liquor, alleged motorcycle or with the
Patna High Court CR. MISC. No.64368 of 2022(2) dt.02-12-2022 2/2 place of seizure.
Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer of the petitioner for anticipatory bail and submitted that the petitioner has four antecedents.
Considering the above-stated facts and considering that petitioner has 4 antecedents and out of them three is of similar nature, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner stands rejected.
This application stands disposed off.
