The petitioner in the present case is seeking regular bail in connection with Bakhri P.S. Case No. 171/2019 (G.R. No. 2138/2019) registered under Sections 304(B)/34 of the Indian Penal Code pending in the court of learned C.J.M., Begusarai.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case and has not committed any such offence as alleged by the informant. Petitioner is the husband of the deceased and has never demanded any dowry from her parents. The deceased died due to accident in the bathroom where she slipped on the wet floor after having about of epilepsy.

Patna High Court CR. MISC. No.59649 of 2019(3) dt.27-11-2019 2/2 Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of this case wherein this petitioner is said to be the husband of the deceased and in course of investigation it has been revealed by some of the witnesses that he was involved in beating the deceased and further that in course of investigation the petitioner has not brought any material before the Investigating Officer showing that the deceased was suffering from epilepsy, though some doctors prescription have been brought on record with the present petition, at this stage, this court is not inclined to grant privilege of regular bail to the petitioner.

Prayer for regular bail of the petitioner is refused. Let the trial be expedited and the trial court is directed to proceed with the matter without granting unnecessary adjournment and complete the trial preferably within a period of nine months from today.
