06-04-2023 Heard learned counsel for the parties.

The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 420, 504, 506 & 34 of the Indian Penal Code.

It is alleged that despite receipt of the consideration money, the land in question was not transferred to the informant. It is submitted on behalf of petitioner that there is no allegation in the F.I.R. that in the partnership deed, the petitioner was in any manner entrusted with the property or domain over property or converted in his own name. It is further submitted that petitioner is not owner of the land in question. The entire money was paid to co-accused Shashank Shekhar Singh, who is land owner, and informant has not given any penny to this petitioner. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.66924 of 2022(2) dt.06-04-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Munger in connection with Sangrampur P.S. Case No. 202 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
