2. The petitioners apprehend their arrest in a case registered for the offence under Sections 303(2), 115(2), 126(2), 117(2), 363(2), 351(2), 352, 3(5) of B.N.S., 2023.
3. As per F.I.R.,all named accused including these petitioners came on the roof of informant's house and started assaulting him and other family members. Petitioner no.2 assaulted on the head of informant by means of Lathi.
4. Learned counsel for the petitioners submits that both parties are agnates and due to land dispute between the
Patna High Court CR. MISC. No.63471 of 2025(2) dt.15-09-2025 2/3 parties, a simple Maarpeet took place, in which, both sides sustained injury. Case and counter case. There is general and omnibus allegation. Injuries, sustained by the informant's wife and daughter, are simple in nature. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State opposes the bail petition and submits that there is specific accusation against petitioner no. 2 that he assaulted informant with lathi on his head and doctor has found grievous injury.
6. Considering the fact that informant sustained grievous injury, caused by petitioner no.2 (Saroj Kumar), his prayer for anticipatory bail is rejected.
7. So far as petitioner no. 1 (Madho Chaudhary) is concerned, there is general & omnibus allegation and no specific overt act has been alleged against him, in the event of his arrest/surrender within a period of eight weeks from today, let the petitioner no.1 namely Madho Chaudhary @ Madhav Chaudhary be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, District - Aurangabad in connection with Obra P.S. Case No. 206 of 2025, subject to condition as laid down under Section 482 of the
Patna High Court CR. MISC. No.63471 of 2025(2) dt.15-09-2025 3/3 B.N.S.S., 2023.
