The petitioner is languishing in custody since 7.7.2019 in a case registered for the offences punishable under Sections 307/34 of the I.P.C. and Sections 3,4 and 5 of the Explosive Substances Act.

The prosecution case as per the written report of Jaichand Sao dated 22.2.2019 submitted to the SHO, Rupo Police Station is to the effect that two persons hurled explosives on the house of the informant. The FIR was registered against unknown. It is alleged that the petitioner confessed his guilt. It is submitted by learned counsel for the petitioner that the confession before the police has no evidentiary value since it did not lead to any recovery. It is further submitted that there is no injury caused to any one. Though the petitioner is accused in

Considering the fact that the explosives did not cause injury to any one, investigation has already been concluded and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM I, Nawada in connection with Kawakol (Rupo) P.S. Case No. 40 of 2019.
