JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 779C of 2017, disclosing offence under Section 498A of the Indian Penal Code. Allegation against the petitioner, who happens to be the husband of the complainant and other accused persons of demand of dowry and ousting her from the house. Submission of learned counsel for the petitioner is that the marriage was solemnized 18 years ago and they have three children. Petitioner is ready to keep her with dignity and care.

Heard learned APP also and perused the impugned

Patna High Court CR. MISC. No.59440 of 2019(2) dt.19-09-2019 2/2 order, from which, it appears that complainant has appeared and she has stated that she wants to live with the petitioner, but petitioner has not appeared before the court below. Having heard both sides, as the matter relates to marital relationship between the parties and their marriage was solemnized 18 years ago and they have 15 years old daughter also, as such, this application is disposed of with a direction to the petitioner to surrender before the learned court below by 30.09.2019 and on surrender, he will be released on provisional bail to the satisfaction of the learned court below. Thereafter, the learned court below shall issue a notice to the opposite party no.2. Once she appeared and shows her desire to reside with the petitioner and the petitioner is ready to keep her with dignity and care, his bail bonds shall be confirmed, otherwise, the learned court below may pass any other order or orders which may be deemed fit and proper, including cancelling provisional bail granted to the petitioner.
