JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 27-11-2018 It is submitted by learned counsel for the petitioner that under her representation dated 12.07.2016 the petitioner widow of the deceased reader in the Department of Zoology, G.M.R.D College, Mohanpur, Samastipur has raised her grievance regarding non-payment of arrears difference arising out of the UGC Scale on account of DA and HRA with effect from 01.01.2006 to 21.01.2010. In her representation dated 12.07.2016 she has referred to the communication dated 09.03.2016 whereby the details of the said dues in respect of the teaching staff including the petitioner's deceased husband has been sent to the Finance Officer of the respondent

Patna High Court CWJC No.16186 of 2016 dt.27-11-2018 2/2 University. No counter affidavit has been filed on behalf of the University controverting the aforesaid case of the petitioner though copy of the writ petition was served on the counsel for the respondent University as far back as on 09.04.2016. No useful purpose would be served by keeping the instant writ petition pending. Petitioner is the widow and she is claiming dues of her deceased husband which as per her representation has been referred to the Finance Officer of the university in the year 2016 itself. This writ petition is therefore, disposed off. The respondent no. 4 would be obliged to consider the claim of the petitioner and make payment of the admitted dues in accordance with law and in case such dues are not found admissible to the petitioner the claim should be disposed off by a reasoned and speaking order. The entire exercise must be completed by the respondent no. 4 within a period of eight weeks from the date of receipt/production of a copy of this order.
