2. The petitioner has preferred this application for grant of regular bail in connection with Muffasil P.S. Case No. 24 of 2024 G.R. No. 1176/2024 dated 24.04.2024 registered for the offences punishable u/ss 302 read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, the informant's sister was married with the co-accused, Sadhu Sada eight years ago with Hindu rites and rituals. It is alleged that all the accused persons named in the F.I.R. including the petitioner used to assault the informant's sister. Later on, 23.04.2023, he received information that his sister had been killed by hanging. On information, when the informant went to the matrimonial house of his sister, he saw that her dead body was lying on the ground. The informant apprehends that all the accused persons including the petitioner
Patna High Court CR. MISC. No.67476 of 2024(3) dt.17-12-2024 2/2 have murdered his sister.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is the debar (brother-in-law) of the deceased and he has no concern with the alleged offence. The petitioner is neither demanded any dowry nor tortured the informant's sister. There is general and omnibus allegation against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 22.06.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Muffasil P.S. Case No. 24 of 2024.
7. The application stands allowed.
