JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The prosecution case is that Mogal Ram, the younger brother of the informant became traceless and subsequently his dead body was recovered from a village pond. On recovery of the dead body, suspicion was raised against the petitioner and her husband as they were not found present in their house. The basis of suspicion was that the victim had some illicit relationship with the daughter of the petitioner.

It is submitted by the learned counsel for the petitioner that there is no eye witness to the occurrence. The postmortem

No.43702 of 2015 (3) dt.30-10-2015 2/2 report reflects no external injury except asphyxia due to drowning and after considering the postmortem report and suspicion nature of accusation, the husband of the petitioner namely Bhadai Paswan has been granted regular bail vide Cr. Misc. No. 23788 of 2015.

Considering the suspicious nature of accusation and the petitioner being lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Thawe P.S. Case No.2 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
