====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 14-11-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 414, 419, 420, 467, 468 and 471 of the IPC.

The prosecution story, in brief, is that the police seized a Truck from Murhena Road which was standing since 18.02.2019 and this petitioner is in process to sell the Truck by showing himself as owner.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 27.03.2019. The petitioner has got no criminal antecedent. The petitioner has been made accused in the present case due to mistake of fact. Charge sheet has been submitted in the present

Patna High Court CR. MISC. No.66881 of 2019(2) dt.14-11-2019 2/2 case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner had no knowledge that the Truck in question is a stolen property. All offences are triable by the Magistrate.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- VI, Nawada, in connection with Narhat (Sitamarhi) P.S. Case No. 90/19.
