2. The petitioner apprehends his arrest in connection with Sabour P.S. Case No. 466 of 2022, initially registered for the offences punishable under Sections 341, 323, 447, 307, 504/34 of the Indian Penal Code but later on, charge sheet was submitted for the offences punishable under Sections 341, 323, 308, 504/34 of the IPC.
3. Prosecution case in short is that on the order of coaccused Ramnath @ Jhabbi Tanti, the petitioner is alleged to have assaulted the informant as a result of which, the informant sustained injury.
4. Learned counsel for the petitioner has submitted that there is land dispute between the parties. The injury sustained by the informant due to assault of the petitioner, is said to be simple in
Patna High Court CR. MISC. No.68982 of 2023(2) dt.02-11-2023 2/2 nature. There is case and counter case between the parties.
5. Learned APP has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances coupled with the fact that the petitioner is a person of clean antecedent, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 466 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) A.K.V.//- U T
