Mr. Parmanand Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 25-09-2025 Heard Mr. Ashad, learned counsel appearing on behalf of the petitioner and Mr. Parmanand Prasad, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Rivilganj P.S. Case No. 129 of 2025 registered for the offence(s) punishable under Sections 30(a) of Bihar Prohibition and Excise Act.
3. As per the allegation made in the FIR 190.08 liters litres of foreign made liquor was recovered near newly constructed Marine Drive dam.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and he has been falsely implicated in the case. He has no concern either with the seized liquor or trade of liquor in any manner. Other co-accused

No.63437 of 2025(2) dt.25-09-2025 2/3 namely Amar Singh @ Amarnath Singh and Bharat Singh @ Bharat Kumar Singh @ Pintu Singh have already granted bail by this Court vide order dated 24.07.2025 passed in Cr. Misc. No.44958 of 2025. On these grounds, petitioner seeks to be released on pre-arrest bail.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail.

Considering the nature of allegation made against the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District Court where the case is pending in connection with Rivilganj P.S. Case No. 129 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS.
7. The petitioner will make his attendance before the concerned police station under which his house is located every Thursday at 10:30 A.M. till conclusion of the trial and on any single default without any valid reasons on the part of the petitioner, his bail bonds shall be cancelled and the concerned SHO of the police station shall submit his
Patna High Court CR. MISC. No.63437 of 2025(2) dt.25-09-2025 3/3 monthly attendance report to the Superintendent of Police having jurisdiction.
8. The learned District Court is directed to verify the criminal antecedent of the petitioner as stated in paragraph no. 3 of the bail application. If any other case is pending against the petitioner as what has been stated in paragraph no. 3, this order will lose its force automatically.
