JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-02-2017 Both the Criminal Miscellaneous are of the same occurrence and as such have been heard together and are being disposed of by passing this common order.

Patna High Court Cr.Misc. No.42833 of 2016 (4) dt.04-02-2017 2/3 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Triveniganj P.S. Case No. 202 of 2015 for the offences punishable under sections 447, 341, 323, 324, 307, 504 and 379/34 of the I.P.C. Allegedly, the petitioners and other co-accused variously armed came to the field of the informant and started abusing and on the order of Jagdish Yadav the accused persons assaulted the informant and others, the accused persons also took away grains, utensils, ornaments etc.

Submission is of false implication and that the allegations are omnibus and general in nature, against the petitioners there is no allegation, there is case and counter case, the case lodged by the petitioners is earlier in point of time, the petitioners have got no criminal antecedents, in this case Jagdish Yadav and Suvans Yadav have already been allowed pre-arrest bail vide Cr. Misc. No. 17686 of 2016 and as such the petitioners also deserve sympathetic consideration.

In the facts and circumstances as stated above, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be

No.42833 of 2016 (4) dt.04-02-2017 3/3 released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. A.C.J.M-II, Supaul in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
