The petitioner apprehends his arrest in connection with Kawakole P.S. Case No. 404 of 2022 for the offence registered under Sections 341, 323, 353, 504, 224 and 506 of the Indian Penal Code.
As per the prosecution story, it has been alleged that in connection with Kawakoli P.S. Case No. 404 of 2022, the police personnel raided the house of Shiv Balak Paswan but allegation is that his daughter (the petitioner herein) blocked their way and raised alarm allowing the accused persons to escape. Accordingly, the FIR.
Learned counsel for the petitioner submits that the police raided the house and having unable to arrest the accused
Patna High Court CR. MISC. No.64269 of 2022(2) dt.11-04-2023 2/2 persons as they were not present in the house, implicated this petitioner, who is young daughter of the accused persons. Learned APP for the State opposes the prayer for bail. Considering the fact that she is a young women, no criminal antecedent, allegation is of locking the passage allowing the accused to escape and the FIR having been lodged, will have to face the music, this Court is inclined to grant her privilege of the anticipatory bail.
Let the petitioner, in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Nawada in connection with Kawakole P.S. Case No. 404 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C.
