JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This is an application for grant of anticipatory bail in connection with Jehanabad (Karauna O.P.) P. S. Case No. 292 of 2019, disclosing offences under Sections 323, 341, 354, 379, 504 and 34 of IPC.

As per F.I.R. there is allegation of harvesting the wheat crops on the field by the petitioners and on protest, they have assaulted the informant and his Bhabhu Ram Kumari Devi and also abused and assaulted them.

Submission of the learned counsel for the petitioners is that there is land dispute between the parties and earlier proceeding under Section 144 of Cr.P.C. was decided in favour of the petitioners (Annexure 3) and there is case and counter case between the parties.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad (Karauna O.P.) P. S. Case No. 292 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
