2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Basantpur P.S. Case No. 236 of 2016 registered for the offence punishable under Section 395 of the Indian Penal Code.

3. Earlier the bail application of the petitioner has been rejected vide order dated 02.04.2024 passed in Cr. Misc. No. 19283 of 2024, which reads as under:

"Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in a case registered for the offence under Section 395 of the Indian Penal Code.

3. As per the prosecution case, petitioner along with other criminals is alleged to have committed dacoity. Petitioner is in jail since 14.01.2024.

4. Petitioner has five criminal antecedents. Petitioner is an absconder in a case of 2016.

5. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner.

6. This application for regular bail is dismissed.

7. The court below is directed to expedite the trial of the petitioner.

8. If the trial is delayed, the petitioner may renew his prayer for bail."

4. Out of 16 witnesses, five witnesses have been examined.

5. Considering the gravity of the offence and the fact that the trial is proceeding, I am not inclined to grant bail to the petitioner.
