JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This is an application for grant of anticipatory bail in connection with Trial No. 993 of 2019, arising out of Complaint Case No. C- 137 of 2019, disclosing offences under Sections 498A, 304B and 34 of IPC.

It appears that petitioner is mother-in-law of the deceased and case is of dowry death.

Submission of the learned counsel for the petitioner is that police after investigation submitted the final form in this case and the postmortem report does not show any injury on the body of the deceased, but on protest petition cognizance has been taken after seven months of the filing of charge sheet. Heard learned A.P.P. also.

Let the petitioner, above named, surrender before the court below within a period of two weeks from the date of receipt of certified copy of this order, on surrender she will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Kumari Jyotsana, learned Judicial Magistrate, 1st Class, Motihari, East Champaran, in connection with Trial No. 993 of 2019, arising out of Complaint Case No. C- 137 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that she has to co-operate in the proceedings.
