2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 309(4) of the B.N.S.

3. The case of the prosecution is that the informant is a toto driver. It is alleged that his toto was booked in 300 rupees and was forced to take the toto to seclude place. It is alleged that two persons assaulted him there and took away the charger and battery of the toto.

4. Learned counsel for the petitioner has submitted that in this case, the name of this petitioner has surfaced on the basis of his confessional statement. Nothing has been recovered from the possession of the petitioner. It has also been submitted that no TIP has been conducted. Learned counsel for the

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Manihari P.S. Case No. 205 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar.
