JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Chhauradano P.S. Case No.99 of 2015 for the offences registered under section 147, 148, 149, 201, 323, 353, 382 and 511 of the Indian Penal Code.

The first information report goes to show that more than 100 persons having armed with deadly weapons stopped the informant from carrying dead body of the deceased of Chhanradano P.S. case No.98 of 2015 and also attacked on police party.

No overt act has been attributed against the petitioner,

Patna High Court Cr.Misc. No.44988 of 2016 (2) dt.08-12-2016 2/2 who does not have any criminal antecedent.

Accordingly, it is ordered that let the petitioner above named, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M., Raxaul at Motihari, East Champaran in Chhauradano P.S. Case no.99 of 2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
