JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner, informant and the State.

The petitioner apprehends his arrest in a case under Sections 307, 379 and 120(B) and other allied Sections of the Indian Penal Code.

The informant alleged that Bigu Yadav assaulted his brother with sword on his head by which he received cut injury. Thereafter, Awadhesh Yadav ordered, upon which Kanhaiya Yadav also assaulted with Farsa. Sukhal Yadav also assaulted his brother. The petitioner is alleged to have assaulted with the butt of the pistol.

The petitioner submits that almost all the family members including 17 persons have been made accused. He submits that the injury caused by the petitioner is simple in nature.

If he surrenders before the court below (Chief Judicial Magistrate, Gopalganj in Maharajganj P.S. case no. 329 of 2014) and prays for regular bail, the same would be disposed of on the same day without being prejudiced by this order.
