Learned counsel representing the State has drawn attention of this Court towards the counter affidavit filed on behalf of respondent no. 3. It is submitted that the investigation in this case has been completed and in course of investigation the allegations have been found true. It is further stated that the Police authorities have already proceeded to arrest the accused persons from Dehradun. Annexure-C to the counter affidavit have been read out to explain the same.
The writ application has been filed for a direction to the respondents to arrest the accused persons. Since the investigating agency has already proceeded to arrest the accused
Patna High Court Cr. WJC No.1712 of 2018(2) dt.04-09-2018 2/2 persons which is evident from Annexure-C to the counter affidavit, this writ application seems to have become infructuous.
It is, however, made clear that in case any slackness is found on the part of the investigating agency and it is seen in future that they have not proceeded to execute the warrant against the accused persons and they have submitted the police final report after conclusion of investigation, this Court will take the same seriously and appropriate orders shall be passed against them.
