JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and State. The petitioner is apprehending his arrest in connection with Karpi P.S. case no. 23 of 2016 for the offence under Sections 147, 148, 149, 341, 323, 379, 386, 387 and 504 of the Indian Penal Code.

The F.I.R. was lodged against unknown and the name of the petitioner surfaced on the confessional statement of one Udal Yadav. In this case, Mahendra Yadav and Satendra Yadav, whose names surfaced on the confessional statement of Udal Yadav, have already been granted anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 44582 of 2017 vide order dated 19.09.2017 and the case of the petitioner is similar to the case of Mahendra Yadav and Satendra Yadav. Considering the ground of parity, the petitioner,

No.53539 of 2017 (2) dt.09-11-2017 2/2 named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Karpi P.S. case no. 23 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
