2. The petitioners are apprehending arrest in connection with Bhargama P.S. Case No. 181 of 2025 instituted under Sections 80, 238, 61(2), 3(5) of the Bhartiya Nayay Sanhita, 2023 lodged on 27.05.2025 by the informant, Narayan Sharma.
3. As per the prosecution story, the informant alleged that his daughter was married to Ganesh Sharma but was always tortured for dowry. On 26.05.2025, she also wanted to worship 'Bat-Savitri' but was forcefully sent to the field to take care maize crops. As she returned, was depressed and enquired from
Patna High Court CR. MISC. No.63401 of 2025(3) dt.10-12-2025 2/3 the in-laws why everyone performed 'Bat-Savitri', she was denied. On this, allegation is that she was again asked to bring dowry. Fed up with that, allegation is that she consumed poison. This led to the death followed by the FIR.
4. Learned counsel for the petitioners submit that the husband is Ganesh Sharma, the father-in-law and mother-in-law namely Dewan Sharma and Rekha Devi are in custody. These petitioners are brothers-in-law and sisters-in-law, living separately having no role to play.
5. Learned APP opposes the prayer submitting that all of them ensured that she did not perform 'Bat-Savitri' which led to her untimely death.

It is unfortunate that the young lady left this world only because she was not allowed to take part in particular ceremony which she otherwise she wanted to perform, the husband is the main culprit, the parents-in-law are in custody, these petitioners are brothers-in-law and sisters-in-law, in that background, this Court is inclined to extend them the privilege of anticipatory bail.
7. Let the petitioners be released on bail, in the event of their arrest or surrender before the subordinate court within a period of four weeks from the receipt of this order, on furnishing
Patna High Court CR. MISC. No.63401 of 2025(3) dt.10-12-2025 3/3 bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each in connection with Bhargama P.S. Case No. 181 of 2025 to the satisfaction of learned C.J.M., Araria subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also the other conditions.
(i) one of the bailor should be the family member/relative of the petitioners who shall provide official document to show his/her bona fide;
(ii) the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself;
(iii) the petitioners shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioners shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Rajiv Roy, J) Ravi/- U T
