JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2017 The petitioner seeks regular bail in connection with Supaul P.S. Case No. 434 of 2017, registered for offences punishable under Sections 452, 379/511 of the Indian Penal Code. Allegation against the petitioner is of attempt to commit theft in the house of informant, who was caught by the covillagers. It has been submitted on behalf of the petitioner that in fact the petitioner was working as labour in the house of informant and informant has confined him and was not giving him any money and on the alleged date of occurrence, he tried to escape from there but informant falsely implicated him in this instance case. Further petitioner has been in custody in this case since 02.08.2017 and though he is an accused in five other cases but he

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of offence and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Supaul, in connection with Supaul P.S. Case No. 434 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner shall mark his attendance before the local police station of his area in the first week of each month at least for a period of one year so that the police may watch his conduct during aforesaid period.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the

Patna High Court Cr.Misc. No.54771 of 2017 (2) dt.20-11-2017 3/3 court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.

Let a copy of this order be communicated to the S.P. of concerned district so as to ensure that petitioner must comply the above directions.
