JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Minapur P.S. Case No.79 of 2014, disclosing offences under Sections 147, 148, 149, 341, 323, 504, 379 and 435 of the Indian Penal Code and 17 C.L.A. Act. Learned counsel, appearing on behalf of the petitioner, states that the petitioner is in custody since 17.07.2015 and similarly situated other co-accused
Patna High Court Cr.Misc. No.47446 of 2015 (2) dt.29-10-2015 2/2 person has been granted regular bail by this Court, vide order, dated 06.04.2015, passed in Cr. Misc. No.13118 of 2015. He further submits that the petitioner was not named in the First Information Report and his name surfaced on confessional statement of co-accused. The petitioner does not have any criminal antecedent, as stated in Paragraph-3 of the application.
Considering the submission as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Minapur P.S. Case No.79 of 2014.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
