The petitioner has prayed for bail in a case registered for the offence punishable under sections 401 and 414 of the IPC and Section 20/22 of NDPS Act.
As per allegation in the FIR, one folding knife of steel, one blade wrapped in paper, 27 tablets of Ativan and one mobile were recovered from possession of the petitioner. On interrogation, petitioner disclosed that with a view to commit theft in train, he used to mix intoxicant tablet Ativan in food items of passenger to make him unconscious.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no
Patna High Court CR. MISC. No.69271 of 2023(2) dt.02-11-2023 2/2 offence. He has been falsely implicated in this Case. The alleged tablet used in treatment of depression. Petitioner has got no criminal antecedent and languishing in judicial custody since 9.7.2023.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Court of Sessions Judge/Special Judge, East Champaran, Motihari in connection with Rail Raxaul P.S.
