2. Petitioner seeks regular bail in connection with Kargahar P.S. Case No. 133/ 2025 dated 05.05.2025 registered for the offence(s) punishable under Sections 80 and 3(5) of the BNS.

The main submissions advanced by the petitioner's counsel are that the petitioner is the mother-in-law of the deceased, in the entire FIR, there is no allegation of dowry demand against this petitioner, in fact, the petitioner has been separate in mess and property from her son, the husband of the deceased and she had been living separately from her son for more than two years prior to the alleged incident. It is further submitted that in the postmortem examination, the cause of death of the deceased could not

No.63636 of 2025(2) dt.17-09-2025 2/2 be ascertained due to which the viscera of the deceased was sent to FSL to determine the cause of death and the deceased died in the hospital. It is lastly submitted that the petitioner is an old lady and has been languishing in jail since 22.06.2025.

On the other hand, the learned counsel appearing for the informant has opposed the bail prayer of the petitioner and submits that earlier in the year 2024, a complaint case was filed by the deceased against this petitioner and other in-laws in which she made allegations of cruelty committed with her by the accused persons.

Considering the aforesaid submissions and mainly taking into account the facts that the petitioner is an old lady and in the FIR, there is no specific allegation against her and the investigation against her has been completed, in my opinion, it is a fit case for grant of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Kargahar P.S. Case No. 133/ 2025 on furnishing bail bond of Rs. 20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
