JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of regular bail arises out of Nokha P.S. Case No. 90 of 2015, disclosing offence under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that another co-accused Arun Kumar has been granted bail by this Court vide order dated 29.09.2015 passed in Criminal Miscellaneous No. 45003 of 2013. He submits that though there is allegation against the petitioner that a motorcycle was recovered on the basis of his confessional statement made before the Police but according to him the said motorcycle, in fact, belongs to the petitioner. He has brought on record a copy of the owner-book by

Patna High Court Cr.Misc. No.47648 of 2015 (2) dt.04-11-2015 2/2 way of Annexure-2 to this application. He submits that both Arun Kumar and the present petitioner were arrested together and upon recovery of country-made pistol from their possession and thereafter, they have been taken on remand in the present case. Considering the facts and circumstances and the submission that other co-accused person has been granted bail, this application is allowed.

Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sasaram, Rohtas in connection with Nokha P.S. Case No. 90 of 2015. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
