2. The petitioner apprehends arrest in connection with Kargahar P.S. Case No. 73 of 2022 dated 26.02.2022, instituted for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Allegation is of recovery of 128.790 litres of illicit foreign liquor from the Car bearing Registration No. UP623V3825.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he been falsely implicated in this case. It is further submitted that petitioner is owner of the said vehicle which was transferred through agreement dated 25.01.2022 in the name of Ramashish Ram and handed over the vehicle to

Patna High Court CR. MISC. No.66163 of 2023(2) dt.07-11-2023 2/2 Ramashish Ram for which a sale letter was executed on 25.01.2022. Lastly, it has been submitted that he has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Since 128.790 litres of illicit foreign liquor has been recovered from the said vehicle which belongs to the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
