2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Gaurichak P.S. Case no. 680 of 2023 instituted for the offence punishable under Sections 341, 323, 504, 506, 420, 467, 468, 120-B of the Indian Penal Code.
3. As per allegation in the FIR, co-accused Amar Prasad fraudulently gifted a land of joint family to his son Aman Prasad and his son thereafter they sold the same land to the petitioner's father after taking full consideration amount.
4. Learned counsel appearing on behalf of the petitioners have submitted that petitioners are innocent and have committed no offence. The present case relates to civil nature and
Patna High Court CR. MISC. No.69836 of 2024(4) dt.10-02-2025 2/2 no criminal case is made out against the petitioners. Petitioner has not cheated anyone. From the FIR, it is clear that Aman Prasad is agnate of the informant. No case under any of the sections is made out against the petitioners. Petitioners have got no criminal antecedent.
5. Learned APP appearing for the State has opposed the prayer of Bail.
6. It appears that petitioners are purchaser of the land after paying consideration amount. Their vendor and informant are agnate. Moreover, this case is of civil nature.
7. Having heard learned counsel for the parties and considering the above facts, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Gaurichak P.S. Case no. 680 of 2023, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Patna City subject to the conditions as laid down under section 438(2) of the Cr.P.C.
