JUSTICE SUDHIR SINGH ORAL ORDER 03-02-2016 The petitioners are apprehending their arrest in connection with Atri P.S.Case No. 27 of 2014 instituted under Sections 341, 323, 325, 307, 379 and 504/34 of the Indian Penal Code.
Heard learned counsel for the petitioners and the State. The allegation against the petitioners is that they assaulted the informant with lathies.
It is submitted on behalf of the petitioners that they have no criminal antecedent. It is further submitted that specific allegation is against Bishnu Yadav, Mukesh Kumar and Antar Devi. No specific injuries have been attributed against the petitioners. It is a case and counter case between the parties.
Patna High Court Cr.Misc. No.48569 of 2015 (3) dt.03-02-2016 2/2 On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Syed Qamrul Rizvi, learned J.M., 1st Class, Gaya, in connection with Atri P.S.Case No. 27 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
